3. Accuracy of Information: You acknowledge and affirm that all information provided to Foundry Funding LLC and its trusted partners is accurate and complete. Furthermore, you agree to promptly notify Foundry Funding LLC of any changes to the provided information.

4. Reliance on Information: Foundry Funding LLC and its trusted partners may rely on the accuracy of the information you provide. Therefore, it is your responsibility to ensure the information is up to date and accurate.

5. Sharing of Information: Foundry Funding LLC may share all information and documents, excluding consumer credit reports, with its trusted partners to fulfill the Applicant's requests.

6. Information Sharing: Foundry Funding LLCand its trusted partners may share information they have about you and the Applicant for administrative, marketing, and servicing purposes as permitted by law. Your personal information may also be shared with the Applicant as part of the underwriting process.

7. Waiver and Release: By agreeing to these Terms of Use, you and the Applicant waive and release any claims against any information provided concerning the release of information.

8. Credit Gathering Authorization: You agree to and accept all terms of the Foundry Funding LLC Credit Gathering Authorization, as specified on the website.

Arbitration Agreement: By using the Foundry Funding LLC website or requesting contact from Foundry Funding LLC for marketing purposes, you agree to arbitrate all claims between you and Foundry Funding LLC (and any entity calling on behalf of Foundry Funding LLC) on an individual basis only and not as part of any class. This arbitration agreement covers all past, current, and prospective interactions with Foundry Funding LLC. By agreeing to arbitration, you waive your rights to a trial by jury, participation in a class action lawsuit or class action arbitration, and bringing an action against Foundry Funding LLC in a court of law. You may individually arbitrate any claim against Foundry Funding LLC in any jurisdiction in the United States. The arbitration shall be governed by the rules of the American Arbitration Association, with the terms of the Foundry Funding LLC Terms of Application and Terms of Use prevailing in case of any inconsistency. The arbitrator will have the authority to interpret the Terms of Application, decide the arbitrability of any claim, and resolve issues related to the scope of arbitration, rules of arbitration, arbitrator's jurisdiction, and enforceability of the Terms of Application. You acknowledge that the Terms of Application involve commerce under 9 U.S.C. Sections 1 et seq. and that this Arbitration Agreement is governed by federal law, including the Federal Arbitration Act. The remainder of the Terms of Application is governed by the laws of New York.

10. Important Information about Opening a New Account: Federal law requires all financial institutions to obtain, verify, and record information that identifies each person and entity that opens an account or establishes a relationship with such an institution. This information includes name, address, date of birth, social security or tax identification number, and other information that allows the financial institution to verify your and/or the entity's identity. You may also be asked to provide identifying documents.
